E-3 Visa for Embryologist
I just (September 2022) received an email from a client with the good news that the interview for her nonimmigrant E-3 visa went smoothly and has been APPROVED. She will be entering the United States by October 1st and will be able to start working immediately. The E-3 visas are approved for 2 year increments which corresponds to the date of the Labor Conditions Application certified by the U.S. Department of Labor.
The nonimmigrant E-3 visa is similar to the nonimmigrant H-1B visa for specialty occupation workers but is currently only available for citizens of Australia. In order to be successful, the applicant must have a job offer from an Employer in the United States in an occupation that normally requires at least a bachelor’s degree in a specific field of study. There is no quota on the number of E-3 visas that are available each year and there is no specific limit on the number of years that the Australian citizen can be on the E-3 visa. As a result, a qualified Applicant can apply for an E-3 visa at any time after he/she has received the job offer. One challenge that my client had to overcome was the limited number of nonimmigrant visa appointments that are available at the U.S. Embassy/Consulates in Australia at this time. As a result of the severe COVID-19 restrictions that were imposed in Australia, the U.S. Embassies and Consulates are still catching up on a backlog of visa applications and, at first glance, there were no visa appointments available for over 3 months. However, my client kept checking the website for available appointment dates (probably because of cancellations) and finally was able to secure one which was closer in time. Her U.S. employer who continues to have openings for Embryologists can’t wait for her to start working in the United States
